End User License Agreement

This End User License Agreement (“EULA” or “Agreement”) is entered into between you and PMM App Development LLC (“Licensor,” “we,” “us,” or “our”). By downloading, installing, or using the BlurtBox Sound Off application (“Licensed Application”), you agree to be bound by this EULA. If you do not agree, do not download, install, or use the Licensed Application.

This EULA supplements — and does not replace — the standard End User License Agreement provided by Apple Inc. for apps distributed through the Apple App Store and Google LLC for apps distributed through the Google Play Store. In the event of any conflict between this EULA and the applicable app store’s standard EULA, the terms more protective of the end user will govern the conflicting provision only.

§ 01License Grant

Subject to this EULA, Licensor grants you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the Licensed Application on any device that you own or control, solely for your personal, non-commercial use, and solely as permitted by the Usage Rules set forth in the applicable app store terms of service.

§ 02Scope of License; Restrictions

The license granted is limited. You agree not to, and not to permit any third party to:

• Copy, modify, or create derivative works of the Licensed Application;
• Reverse-engineer, decompile, disassemble, or otherwise attempt to discover source code (except to the extent this restriction is prohibited by applicable law);
• Remove, alter, or obscure any copyright, trademark, or other proprietary notices;
• Use the Licensed Application to violate any law, regulation, or third-party right;
• Use the Licensed Application to transmit harmful code or interfere with others’ use;
• Rent, lease, sublicense, or transfer the Licensed Application except as permitted by the applicable app store’s terms.

§ 03Consent to Use of Data

You acknowledge and agree that Licensor may collect and use limited technical data as described in our Privacy Policy, which is incorporated by reference into this EULA. The Licensed Application is designed to operate without collecting personally identifiable information.

§ 04User-Generated Content and Community Standards

The Licensed Application hosts user-generated content. By using the Licensed Application, you acknowledge the following, which are material terms of this EULA:

• You must be at least 18 years of age to use the Licensed Application;
• You will not upload, post, or transmit objectionable content, including content that is abusive, threatening, defamatory, obscene, infringing, or otherwise unlawful;
• You understand that Licensor has a zero-tolerance policy for objectionable content, especially content that exploits or endangers minors, and will remove such content within 24 hours of becoming aware of it and will ban the responsible user or session;
• You may report objectionable content or abusive users through the in-app reporting tools;
• You may block abusive users through the in-app blocking feature;
• Licensor may, at its sole discretion, remove any content and terminate access for any user who violates community standards.

§ 05Services from Third Parties

The Licensed Application may rely on third-party services (such as Supabase, Vercel, Stripe, Expo, Apple Push Notification Service, and Google Firebase Cloud Messaging). Your use of those services may also be governed by their respective terms. Licensor is not responsible for third-party services.

§ 06Maintenance and Support

Licensor is solely responsible for providing maintenance and support services related to the Licensed Application, as required by applicable law. Apple and Google have no obligation to provide any maintenance or support services relating to the Licensed Application. Support inquiries should be directed to hello@blurtboxsoundoff.com.

§ 07Warranty

Licensor is solely responsible for any express product warranties, whether mandated by law or offered voluntarily. In the event of any failure of the Licensed Application to conform to any applicable warranty, you may notify Apple (if applicable), and Apple will refund the purchase price for the Licensed Application; and to the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the Licensed Application. To the maximum extent permitted by law, the Licensed Application is provided “AS IS” without warranty of any kind.

§ 08Product Claims

Licensor, not Apple or Google, is responsible for addressing any claims you or any third party may have relating to the Licensed Application or your possession and/or use of the Licensed Application, including but not limited to: (i) product liability claims, (ii) any claim that the Licensed Application fails to conform to any applicable legal or regulatory requirement, and (iii) claims arising under consumer protection, privacy, or similar legislation.

§ 09Intellectual Property Rights

In the event of any third-party claim that the Licensed Application or your possession and use of the Licensed Application infringes that third party’s intellectual property rights, Licensor, not Apple or Google, will be solely responsible for the investigation, defense, settlement, and discharge of any such intellectual property infringement claim.

§ 10Legal Compliance

You represent and warrant that (i) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a “terrorist supporting” country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.

§ 12Third-Party Beneficiary

You and Licensor acknowledge and agree that Apple Inc. and Apple’s subsidiaries (for iOS distribution) and Google LLC and its subsidiaries (for Android distribution) are third-party beneficiaries of this EULA, and that upon your acceptance of the terms and conditions of this EULA, those parties will have the right (and will be deemed to have accepted the right) to enforce this EULA against you as a third-party beneficiary.

§ 13Governing Law

This EULA is governed by the laws of the State of Illinois, without regard to conflict-of-laws principles. This choice of law does not apply to any claim by a consumer who has statutory rights that cannot be waived under the law of their country of residence.

§ 14Entire Agreement

This EULA, together with the Terms of Service and Privacy Policy available at https://blurtboxsoundoff.com, constitutes the entire agreement between you and Licensor concerning the Licensed Application and supersedes all prior understandings.
